Clarification on Children Education Allowance and Hostel Subsidy - DOPT Order

Department of Personnel and Training has published in its website today, an important clarification order[No.1211/08/2010-Estt.(AL) dated on 30.12.2010] about the Children Education Allowance and Hostel Subsidy issue.
This department has already issued some clarifications through the previous orders, still further doubts receiving from various department of Central Government to DOPT.
Now, clarifications given as some type of 'questions and answers' by the DOPT.
This order is very useful to Central Government Employees to clear the doubts regarding the Children Education Allowance Scheme...

We have given some answers collected from this order...

1. The upper age limit for children will now be 20 years or till the time of passing 12th Std. whichever is earlier.

2. 'One set of shoes' means 'One pair of shoes'.

3. 'Two sets of uniform' means a set of uniform will include all items of clothing prescribed for a day and irrespective of the colours/winter/summer/PT uniform.

4. 'Station' means first three digits of the PIN Code(indicate Revenue District) of the area where the employee is posted and /or residing.

5. No reimbursement whether the fee paid to Private Tutors.

Special benefits in cases of death and disability in service - DOPT Order

Subject:   Special benefits in cases of death and disability in service – payment of disability pension/family pension – relaxation of qualifying service :-

     The undersigned is directed to say that the scales of disability pension admissible under CCS (EOP) Rules were laid down in para 3 of Department of Pension & Pensioners’ Welfare’s O.M. No.45/22/97-P&PW(C) dated 3.2.2000. The said O.M. dated 3.2.2000 was modified vide Department of Pension & Pensioners’ Welfare’s O.M. No.45/3/2008- P&PW (F) dated 18-11-2008.

2.     The service element of the disability pension under Categories ‘B’ and ‘C’ of this Departments’ O.M. No.45/22/97-P&PW(C) dated 3.2.2000 is regulated by the CCS (Pension) Rules, 1972 and CCS (EOP) Rules, according to which only service gratuity is admissible to Government servants with less than 10 years qualifying service and pension is admissible for qualifying service of 10 years or more. The matter has been reviewed by the Government considering the hardships being faced by the disabled Govt. servants who have less than 10 years qualifying service at the time of discharge and it has been decided that the disability pension of Govt. servants who are discharged from Govt. service will be regulated as under:

      Disability Pension – for cases covered under categories ‘B’ and ‘C’

        (1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Government servant) and gratuity admissible under the CCS(Pension) Rules, 1972, plus disability element equal to 30% of basic pay, for 100% disability. There shall be no condition of minimum qualifying service for earning service element. No service gratuity would be admissible. The condition of minimum of qualifying service of 5 years for payment of gratuity would continue to be admissible/applicable in accordance with Rule 50 of CCS (Pension) Rules, 1972.

        (2) For disability less than 100%, disability element of disability pension shall be reduced proportionately. In cases of disability pension where permanent disability is not less than 60%, the disability pension (i.e. total of service element plus disability element) shall not be less than 60% of the reckonable emoluments last drawn subject to a minimum of Rs. 7000/- per month.

        Disability pension – For cases covered under Category ‘D’

        (1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Govt. servant) and gratuity to which the employee would have been entitled to on the basis of his pay on the date of invalidation but counting service up to the date on which he would have retired in the normal course and disability element equal in amount to normal family pension subject to the condition that the aggregate of the service and disability element shall not be less than 80% of the pay last drawn, for 100% disability. There shall be no condition of minimum qualifying service for earning service element. No service gratuity would be admissible.

        (2) For lower percentage of disability, the disability element shall be proportionately lower as at present subject to the broad banding of percentage of disability as in OM dated 3/2/2000.

        Disability pension – For cases covered under Category ‘E’

        (1) Disability pension comprising a service element equal to the retiring pension (@50% of the emoluments or average emoluments received during the last 10 months, whichever is more beneficial to the Govt. servant) and gratuity to which the employee would have been entitled to on the basis of his pay on the date of invalidation but counting service up to the date on which he would have retired in the normal course and disability element equal to pay last drawn. There shall be no condition of minimum qualifying service for earning service elements. No service gratuity would be admissible.

        The condition that the aggregate of the service and disability elements shall not exceed the pay last drawn for 100% disability – stands withdrawn w.e.f. 1.7.2009.

        (2) For lower percentage of disability, the disability element shall be proportionately lower as at present subject to the broad banding of percentage of disability as in OM dated 3.2.2000.

3.     Other terms and conditions in the CCS (EOP) Rules and Liberalized Pensionary Awards Scheme which are not specifically modified by these orders shall continue to remain operative.

4.     These orders will be effective from 01.01.2006.

5.     This issues with the concurrence of the Ministry of Finance, Department of Expenditure vide their U.O. NO.515/EV/2010 dated 26.10.2010.

6.     In so far as persons belonging to the Indian Audit & Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

Subject: SENIORITY - Consolidated orders on...

The undersigned is directed to say that instructions have been issued by this Department from time to time laying down the principles for determining seniority of persons appointed to services and posts under the Central Government. For facility of reference, the contents of the important orders on the subject have been consolidated as a compilation "Instructions and Guidelines on Seniority". The number and date of the original O.M.'s has been referred in the relevant instructions* for easy reference to the context. The consolidated instructions include revised instructions on the following:

i. Seniority of persons appointed on direct recruitment from the reserved panel at a later date, specifically when the officers from the subsequent selection panel have already joined.

ii. Inter-se seniority of two panels of direct recruits, where more than one selection panel are received from UPSC/SSC through letter of same date.

iii. Fixation of seniority of a person who has been transferred to a lower post under FR 15-A.

iv. Seniority in case of appointment on compassionate grounds

2. Also, certain areas within the existing instructions, which require frequent clarifications, as is evident from the references received from various Ministries/Departments, have also been incorporated under the head "clarification", for reference. This may be brought to the notice of all concerned for information, guidance and necessary action.

3. The consolidated instructions along with Annexure containing O.M.'s referred wlll be issued separately in the form of handbook.

Sub: Study Leave for Fellowships offered by reputed Institutes.

Study Leave is normally granted to a Government Servant for a course of study having direct and close connection with the sphere of his duty. However, it can also be granted for studies which may not be closely or directly connected with the work of a Government Servant, but wliich are capable of widening his mind in a manner likely to improve his abilities as a civil servant and to equip him better to collaborate with those employed in other branches of the public service. Keeping in view the above spirit, this Department had allowed Study Leave to those selected for the award of Jawaharlal Nehru Fellowships in relaxation of the rules.

2. In light of the above, this Department is examining the feasibility of bringing more Fellowships under the purview of Study Leave, on the same terms and conditions as the Jawaharlal Nehru Fellowships. All Ministries/Department are requested to provide relevant /requisite inputs regarding fellowships offered by reputed institutions which may be of benefit to their area of work. It would be appreciated if the feed back is received by the under signed by 15th December 2010. The same may be mailed to the under signed at pads@nic.in.

Subject: Departmental proceedings against Government Servants – consultation with the Union Public Service Commission for advice.

The undersigned is directed to say that the existing instructions issued by this Department provide that the disciplinary proceedings taken against Government servants should be processed and completed expeditiously. Occasionally, the charged officers approach the Courts to quash the disciplinary proceedings and in many such cases the courts give direction to the Government to complete the proceedings within a time limit prescribed by the court. In certain instances the Government seeks further time from the court and in certain other instances, the petitioners file contempt petitions for not having completed the proceedings as per the court orders. In many of such cases , the UPSC has to be consulted as per the existing regulations, before the final orders are issued.

The UPSC has brought to the notice of this Department that In the above cases, some Ministries / Departments have stated in the affidavit flied before the Court that the matter has been pending with the UPSC and the delay in completing the proceedings was due to the delay In result of advice from the UPSC although such canes had been returned by the Commission to the Administrative Ministry to rectify the deficiencies noted by it In this connection, attention of Mlnlstrles/ Departments Is drawn to this Department’s OM of even number dated 10.5.2010 and 14.9.2010 In which it has been reiterated that the Commission generally takes 3-4 months to render its advice matter the complete case record8 have been received by the Commission and that the Ministries / Department should ensure that the prescribed proforma for mending the case records to the UPSC filled with due care and attention to avoid any back reference by the Commlaelon to rectify the deficiencies.

A case may not be taken as delayed on the part of UPSC If the Commission has returned the same to the Administrative ministry to remove deficiencies.

All Ministries / Department. are requested that In cases where the Courts are being apprised the time taken in finalizing a disciplinary proceeding through affidavit, information In regard to the pendency of the matter before the Union Public Service Commission may be correctly projected.

1. Issue of Corrigendum PPO for Pre-2006 retirees.

While the need for issuance of corrigendum PPO was accepted and implemented for Post-Jan 2006 retirees, the Pre-Jan 2006 cases were left out for issue of corrigendum PPO due to vast number of retirees. A large number of complaints and difficulties faced by few Air Warriors reflect non payment of rightful dues by various Banks due to lack of requisite information, especially State Bank of India, despite directive by PCDA, Allahabad vide Circular No.397 & 403 dated 18 Nov 09 & 02 Feb o9. The problem is genuine and needs suotable directions for issuance of Corrigendum PPO for all Pre-2006 retiree also. Incorporating required details viz date of birth of Pensioner, name & date of birth of the family Pensioners/nominee details; date of retirement is essential for fixation of pension/ Additional Pension or Family Pension to beneficiaries especially past retirees prior to 1986, beside those above 80 years of age.

Due to non-availability of authenticated details, Banks are unable to give rightful dues to the Pensioner/Family Pensioners especially to those who are residing in rural areas and are not aware of their actual entitlement on Pay Commission revision. The subject of issuance of corrigendum PPO needs priority directions for outsourcing the task if not feasible within CDA capacity.
2. To communicate the amount of pension as well as Family Pension to be revised consequent to the 6th Pay Commission to individuals pensioners of Pre – 2006.

A Period of more than one year is over. But most of the existing pensioners who have been retired before 01-01-2006 have not been communicated the revised amount of Pension as well as Family Pension admissible to the spouse on his / her death. As a result the Family Pensioner is put to hardships on death of his / her pensioner spouse. Necessary instructions may be issued to communicate the revised amount of pension / family pension in PPO or individual pensioners by the Pension Disbursing Authorities.
3. Expediting cases of sanctioning of secondary family pension with monitoring mechanism at various levels. All cases of undue and unjustified delays to be viewed seriously and concerned authorities made accountable.

4. Same fitment benefit to Pre-2006 pensioners as recommended and implemented in respect of serving employees by the VI CPC.

The VI CPC discriminated against Pre-2006 pensioners in the matter of fitment benefit. While Grade Pay was recommended to employees in addition to merger of 86% D.A. as on 1-1-2006, pensioners were recommended only 40% if basic pension which works out to much less than 50% of grade pay. Grade Pay was worked out at 40% on the maximum of the highest pay scale in the group of pay scales coming under each grade pay while past pensioners retired at various stages in their respective pre-revised pay scales. Thus an imbalance is created between pre and post 2006 pensioners which will be rectified only if the same fitment benefit is granted to Pre-2006 pensioners also i.e., basic pension as on 1.1.1996 + 86% D.R. and 50% of relevant grade pay. Unless the above imbalance is rectified, the pre-2006 pensioners and family pensioners will forever lag behind post-2006 pensioners and family pensioners retiring in comparable posts with equal number of years of service. Implementation of VI CPC recommendation in the above regard widened the gap between pre and post 2006 pensioners rather than bridging it. Though the CPC had observed in para 5.1.47 of their report that” In order to maintain the existing modified parity between the present and future retirees it will be necessary to allow the same fitment benefit as is being recommended for the existing Government employees” however, in their recommendations, the commission did not carry the above. The commission had not realized that they were recommending a different fitment benefit to pre-2006 pensioners putting them at a serious disadvantage vis-à-vis future pensioners. The same fitment benefit needs to be extended to Pre-2006 pensioners and family pensioners to do equal justice to them. The IV CPC desired that factors governing pay determination should also apply for pension determination (Para 2.26 of IV CPC report, Part II – Pension).
5. Parity between Past and Future Pensioners.

There has been constant effort on the part of the earlier pay commissions to bridge the gap between pensions of past and future pensioners retiring in comparable posts. More improvements have come about in the pension structure after independence as the country progressed economically and in other respects. In line with this trend, the V CPC had enunciated parity principle in para 137.14 of their report. The V CPC enunciated this principle with the laudable objective of bringing the pensions of past pensioners close to those of future pensioners. They recommended full parity to those who retired prior to 1.1.86 i.e, the date of implementation of IV CPC scales of pay and modified parity w.e.f. 1.1.96. They desired that the same formula be followed in respect of Pre-1996 pensioners and family pensioners at the time of implementation of VI CPC recommendations w.e.f. 1.1.2006 vide para 13 7 .21 of their report. The V CPC did not straight away recommend full parity upto 1-1-96 though they felt it was desirable only having regard to the financial implications of implementation of such a measure at that point of time. They observed in para 137.13 of their report as follows:

“The process of bridging the gap in the pension of pensioners has already been set in motion by the fourth CPC when past pensioners were granted additional relief in addition to consolidated of their pension. This process of attainment of reasonable parity needs to be continued so as to achieve complete parity over a period of time.”

The Govt. of India accepted parity principle enunciated by the V CPC and implemented the same w.e.f. 1.1.1996 in respect of Pre-1986 pensioners and family pensioners. It is, therefore, incumbent on the part of the Govt. to carry forward this principle to Pre 1.1.1996 pensioners w.e.f. 1.1.2006. It is not correct for the Government to abdicate this responsibility. The VI CPC was erroneous in linking parity with cent percent neutralization of price rise for the following reasons.

1. Cent percent neutralization of price rise was there upto certain levels even prior to 1.1.1996 and

2. It was the V CPC which recommended taking forward parity principle as well as extension of cent percent neutralization of price rise to all levels.

Hence there was no link whatsoever between carrying forward the principle of parity and 100% neutralization of price rise. The commission’s observation had created a wrong and misleading impression in the above regard. The Central Government will, therefore, do well to discharge their moral responsibility towards their past employees by carrying forward the parity principle. Pre-1.1.1996 pensioners and family pensioners may, therefore, be first brought on par with post 1.1.1996 pensioners and family pensioners as recommended by V CPC while revising their pensions as per V CPC formula.
6. Stepping up of Pension and Family Pension to 50% and 30% respectively.

The stepping up of pension and family pension to 50% and 30% respectively of the sum of the minimum of the pay in the pay band and grade pay thereon corresponding to the pre revised pay scale from which the pensioner ha retired (Para 5.1 of VI CPC report). The manner in which this recommendation has been implemented has done grave injustice to pre 1.1.2006 pensioners. Instead of taking the pay in the pay band corresponding to the minimum pay of the pre revised pay scale, minimum pay in the pay band has been taken for this purpose and thus those who retired in higher pre revised pay scales have been equated with those who retired in lower scales. Thus equal treatment has been denied to those who retired in various pre revised pay scales in the matter of ‘stepping up’. While those who were given separate pay scales were protected in this regard, those whose pre revised pay scales had come into pay bands have been adversely affected. This is a gross discrimination denying equal treatment as enshrined in Article 14 of the Constitution of India As such the ‘Stepping up’ may be implemented so as to protect all those who retired in various pre revised pay scales replaced by four pay bands. Introduction of pay bands with grade pay should not be allowed to act to the serious detriment of any section of past pensioners.
7. Extension of new benefits granted to the past pensioners. The Hon’ble Supreme Court of India had categorically ruled in their historic Judgment in Nakara case that dividing the homogeneous class of pensioners into those retiring before and after a certain date in the matter of extending new pensionary benefits granted is unconstitutional and violative of Article 14 of the Constitution of India. Yet, the Government of India limited the new benefits such as (a) taking last pay drawn or average of last 10 months of pay whichever is beneficial to the retiring employee for computation of pension and (b) full pension for 20 years qualifying service/10 years of qualifying service in superannuation case to those retiring after 1-1-2006 in the case of (a) of the above and 2-9-2008 in the case of (b). The representations made against the above violation are disposed of by the Dept. of P&PW, New Delhi vide their letter No.F.No. 38/37/0 p&pw (A) dt. 11-2-2009 on untenable grounds. Hence a presidential reference needs to be made to the Supreme Court to clarify whether or not the above orders of the Government violated the letter and spirit of their judgment in Nakra Case instead of driving the retired employees to approach courts of law in their advanced ages. The Government should be fair enough to its retired employees and their families as this is an issue with far reaching consequences to them.
8. Additional pension for service beyond 20 years of service.

In this connection, the reasoning given by the VI CPC in recommending additional pension for service above 33 years of qualifying service may kindly be seen and service above 20 years suitably rewarded.
9. A suitable alternative to merger of DR after it reaches 50% in view of VI CPC recommendation against 50% DA/DR merger benefit to ensure revision at reasonable intervals.
10. Appointment of 7th Central Pay Commission, HRA & Transport Allowance, Children’s educational allowance & Hostel Subsidy and Festival Advance.

11. Restoration of commuted pension after 12 years. The V CPC recommended restoration after 12 years taking all relevant factors into consideration. There are no subsequent developments to justify reversing of this recommendation by the VI CPC. The Government would so well to issue orders restoring commuted pension after 12 years as grave injustice is being done to pensioners in not accepting and implementing recommendation of the V CPC in the above regard.
12. Revision of Ex-gratia rates in respect of pre. 1986 CPF/SRPF retirees and their families.

a) Revision of these rates effected w.e.f. 1.11.2006 gave them only marginal benefit. Even in this, those who retired from groups B,C & D are badly hit as the increases in their cases are very negligible. Ex-gratia rates applicable to families of deceased beneficiaries remain the same. These ex-gratia beneficiaries and their families have to be done justice by revising their ex-fratia rates in the same manner as was done in the case of pensioners.

b) Further they are given 8% less DR which again is highly discriminatory. Further, the present discrimination against families of the beneficiaries getting ex-gratia in the matter of DR should end.

c) They should also be made eligible for grant of FMA on par with pensioners.
13. Ex-gratia amount to be raised for CPF/SRF retirees.

a) The Ex-gratia amount sanctioned to CPF/SRPF retirees is very low. It should be raised to 50% of the minimum of the corresponding pay scale fixed by the VIth CPC for groups A, B, and C and D. The total number of such CPF/SRF retirees alive today are negligible. Government has restored and revised 1/3rd pension of PSU Absorbees who had commuted 100% pension based on the court order. Therefore, it is not justified to deny revision of Ex-gratia to these small groups of people. They also should be given reasonable amount of Ex-gratia to maintain their day to day needs.

b) Ex-gratia to widows of CPF/SRPF retirees is to be raised and paid uniform rate of D.R.

c) Sanction Ex-gratia to CPF / SRPF voluntary retirees with 20 years of service, since the denial of the benefit is unjustified.
14. Ex-gratia should not be less than minimum pension and the same should be effective from 01/01/06.
15. Extension of secondary family pension to dependant widowed daughter-in-law.
16. Extension of benefit of enhanced family pension for 10 years even in cases of death after retirement.
17. Fixed Medical Allowance to be enhanced to Rs. 1,000.00 p.m w.e.f. 01/01/06.
18. Implementaion of Web Based Pensioners Portal-

Online Grievance redressal system:


Live status as well as final status does not get reflected. The system of ,monitoring by DOP need to be strengthened and DOP need to have teeth to ensure compliance from different Departments.

b) Grant in aid to pensioners Associations to cover ‘Rent’ for office accommodation:


Most of the Pensioners Associations, due to inadequate finances, find it hard to hire adequate office accommodation. To facilitate smooth & effective working provision for office accommodation ‘Rent may’ be made in the Grant- in-aid to pensioners Associations.
19. The implementation of orders dated 01.09.2008 read with the orders dated 14.10.08 is not correct. For instance, consider the example given at Sl. No. 3 of the Annexure-II dealing with Pre-revised scale of pay Rs5,000-8,000 in PB-2 of Rs 9300-34800 with Grade Pay of Rs.4200/-. The RCP arrived as per the recommendations was at Rs. 5,650/- and the same is asked to be stepped up to Rs.6,750/- vide OM ibid. Since Fitment Scale for this scale starts at Rs.9300/- Pay Band it is correct. But it the next scale Rs.5500-175-9000 is taken ito consideration with the same Grade Pay it should not be limited to 6750/- since the Fitment Scale is Rs.10,230-17,720 for this scale. It should be compared with the minimum admissible pension of Rs.7225/- (Rs.5115 + Rs.2100) being 50% of the Minimum of the Pay Band + Grade Pay of Rs.4200/- related to the post.The Grade Pay is also varies for the same post carrying the same scale of pay when Implemented in the different departments. As such, the Pension Calculator should not be relied upon but case to case examine of pensioner’s case has to be ensured vide Annexure-III to the OM ibid.

20. Health Care of Pensioners / Family Pensioners residing in the Non-CGHS areas is badly neglected. The Orders of Health Ministry reiterating that all the pensioners are at liberty to enroll themselves with any of the nearest CGHS hospital/dispensary may be widely circulated. The Implementation of the orders enforced. Already pending bills with the Heads of Departments concerned for which claims made under the existing CS (MA) Rules, 1964 should be settled on the strength of decisions given by various Hon’ble CATs in the country.

(a) Merger of Postal Dispensaries with the CGHS should be expedited. In the meanwhile, the pensioners of Departments of Posts and Telecom may be allowed as in the case of other Officials on deputation to Public Sector Undertakings to join the CGHS on a life time measure on a regular basis to avail the CGHS facility.

(b) The rates of contribution raised w.e.f. 1-6-2009 are to be reduced and also the renewal of issue of regular CGHS cards should be allowed for those beneficiaries who were already registered with the CGHS on a temporary basis renewing their Cards periodically without insisting upon the rates increased w.e.f. 1.6.2009.
21. Withdrawal of arbitrary orders dated 01/08/1996 and 01/09/1996 issued by Ministry of Health and Director of CGHS. It is requested to apprise the DOT to make a General Rule and all similarly placed pensioners are considered for Service Telephones.
24. The existing Pensioners of Department of Posts and Telecom covered by P&T Dispensaries are neither consider for treatment of hospitalization facilities nor for Fixed Medical Allowance.

This item was included in previous SCOVA meeting held on 25-03-2008, but it is still undecided. This may be settled and decided now.
Pensioners falling within the limit of P&T Dispensaries / CGHS Hospitals may be allowed to opt for P&T Dispensaries or drawl of Fixed Medical Allowance.

The existing pensioners may be allowed either to opt for Fixed Medical Allowance or the facilities of P&T Dispensaries / CGHS.

Govt. has provided necessary relief to Lt Gen (Retd) and equivalent in providing benefit of modified parity. The matter has already been projected at Chiefs of Staff Committee level in Aug 09. The parity amount as suggested below would eliminate grievance of major retirees of Pre-2006 period.

26. Disability Pension: Extension of benefit to Pre-Jan 2006 disability Pensioners.

Disability pension for Pre-Jan 2006 retiree is based on fixed amount as per Govt. of India, MoD letter. No. 16(6)/2008()/D (Pebsion/Policy) dated 04 May 2009. This has resulted in large disparity in disability elements related benefit, when compared to post Jan-2006 retirees (who are entitled forv30% of last enhanced pay drawn amount on retirement as per letter of even reference dated 05 May 09). The issue needs a review for providing benefit of disability pension to earlier retiree, on the same yardstick, as applicable now for Post-Jan 06 retiree.

Subject:   Allowing vigilance functionaries on deputation to CPSEs the option to draw pay either in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any - Cabinet decision - reg.



           The Government had set up a Committee (2nd Pay Revision Committee) to examine and recommend changes in the pay structure, allowances, perks and benefits of the Central Public Sector Enterprises (CPSE) employees. The recommendations of the Committee were considered by the Department of Public Enterprises (DPE) and also by the Cabinet. Based on the decision of the Cabinet, the DPE had issued an O.M. No. 2(70)/08-DPE(WC) on 26th November, 2008, proclaiming the revised pay structure in CPSEs.

2. As per para 12 read with para (iv) of Annex. -1V of the above O.M., only those Government officers who come on permanent absorption basis, will get the CPSE scales, perks and benefits. However, as per guidelines for appointment of CVOs in CPSEs etc issued by DoP&T vide their OM No. 372/8/99-AVD-III dated 18th January, 200 1, the CVOs are allowed to exercise their options to draw the pay of the post in the CPSE or their grade pay. This provision is based on the policy that the CVOs are to be posted on deputation from outside the organisation and they are not allowed to be permanently absorbed in that CPSE.

3. This issue was considered by the Cabinet in its meeting held on 5th October, 2010, which decided that the Department of Public Enterprises's O.M. No. 2(70)/08-DPE(WC) dated 26.11.2008 stand amended to the effect that -

(i) CVOs and other officers on deputation to the Vigilance Departments of CPSEs may be allowed the option of electing to draw either the pay of the post in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any.

(ii) The CVOs and other oficers on deputation to the Vigilance Departments in CPSEs may also be allowed all the perks, benefits & perquisites applicable to equivalent level of officers in concerned CPSEs.

Subject: - Instructions regarding Writing of Annual Confidential Reports (ACR) in respect of Central Health Services Officers - reg.

The undersigned is directed to draw attention to the enclose copy of DOPTs Circular O.M. No.21011/1/2010 Estt.A dated 13.4.2010 whereby DOP&T ahs issued fresh instructions inter-alia stating that in case, an employee is to be considered for promotion and his ACR prior 2008-09 contain final a copy of the relevant ACR for his representation, before such ACRs are placed before the DPC/ only the below bench mark ACRs for the period relevant to promotion need be sent to the concerned officers."

2. In pursuance to this several representation from the affected officers have been received. while considering the representations from the affected officers viz-a-viz, it has been observed that while writing the ACRs of the officers, the Reporting Officer has simply marked against each Column as "Good" and this has been accordingly made the final Assessment as "Good", without giving any reason for making this grading. For instance, under Col. "Please comment to write at some length, while making the Assessment. Likewise, the overall assessment where the direction is that strength and shortcomings of the officer should be reported upon, even here the total assessment is simply given as "Good".

3. This has created confusion in considering the representations of the concerned Officer for up gradation of the grading in the ACRs. Since the Grading given in the ACRs affect the future promotion /s of the concerned officers, all Reporting/Reviewing Officers are directed to apply their mind while recording entries, with the full understanding that these entries will be extremely crucial in determining the future career of the officers in the service.

Sub:    Implementation of Government’s decision on the recommendations of the Sixth Central Pay Commission – Revision of pension of pre-2006 pensioners/family pensioners etc

    The undersigned is directed to say that in this Department’s O.M. of even number dated 21.5.2009 and 11.8.2009 it was provided that in case the information regarding date of birth/age is not available in the PPO or the office records, certain documents , viz. PAN Card, Matriculation certificate, Passport, CGHS Card, Driving licence and Voter’s ID Card, would be accepted as proof of date of birth/age for payment of additional pension/family pension on completion of age of 80 years and above. It was also provided that the Pension Disbursing Authority/Bank will make payment of additional pension/family pension in the above manner, on provisional basis, up to a period of three months from the month in which the proof of age/date of birth is submitted by the pensioner/family pensioner. In such cases, the Pension Disbursing Authority/Bank will immediately send one copy each of the document submitted by the pensioner/family pensioner to the Pay and Account Officer/CPAO for formal authorisation of the additional pension/family pension. The Pension Disbursing Authority/Bank will make payment of additional pension/family pension beyond a period of three months only on receipt of such an authorisation from the Pay and Account Officer. These instructions were reiterated in this Department’s O.M. of even number dated 25.6.2010.

2.     It has been brought to the notice of this Department that, in many cases, final authorisation could not be communicated by Pay & Accounts Offices to the Pension Disbursing Banks even after expiry of the stipulated period of three months from the month in which the proof of age/date of birth was submitted by the pensioner/family pensioner on account of non-receipt of sanction from the Heads of Offices.

3.     Considering the hardship that is likely to be caused to the old pensioners/family pensioners due to discontinuance of additional pension by the Pension Disbursing Authority/Bank in such cases, it has been decided that where the pensioner/family pensioner has submitted any of the prescribed documents as proof of age/date of birth, etc., payment of additional pension/family pension, on provisional basis, will continue to be made till 31.12.2010 or for a period of six months from the month in which the proof of age/date of birth was submitted by the pensioner/family pensioner, whichever is later. The Heads of Offices may ensure that all formalities regarding sanction may be taken up and additional pension sanctioned within the same period. In case the pensioner/family pensioner is unable to submit any of the documents mentioned in OMs dated 21.5.2009 and 11.8.2009 but claims additional pension based on some other documentary evidence, such cases will be submitted to the administrative Ministry. If the administrative Ministry is satisfied about the claim of the pensioner/family pensioner, it will authorise additional pension/family pension accordingly. The decision of the Administrative Ministry in this regard will be final.

Subject:    Modified Flexible Complementing Scheme for Scientists based on the recommendations of the 6th Central Pay Commission

            A Flexible Complementing Scheme (FCS) for scientists is in position in some of the scientific Ministries/Departments of the Government of India and the same is presently governed by the guidelines issued by this Department under O.M. No.2/41/97-PIC dated the 9th November, 1998. There is also in position a separate, merit based promotion scheme in the DRDO and the Departments of Atomic Energy and Space. The Sixth Central Pay Commission (6th CPC) has examined these schemes in detail and observed that various time-bound promotion schemes may be necessary for scientific organizations as the morale of the scientists has to be kept high in order to keep them motivated and to stop the flight of talent from Government organizations involved in research and scientific activities. In this context, the 6th CPC has recommended that the existing scheme of FCS with necessary modifications has to be continued for R&D professionals in all S&T organizations, and the merit based promotion scheme in the Departments of Atomic Energy, Space and DRDO would also need to be persisted with. The Commission has, however, recommended certain features to be incorporated in the existing schemes of FCS and merit based promotion scheme so as to make them more relevant to the context.

2. The recommendations of the Commission have been examined in detail in the context of FCS and a revised comprehensive scheme is enclosed for immediate necessary action by all concerned Ministries and Departments. All the Ministries / departments shall initiate action for review of the provisions of the Flexible Complementing Scheme and amend the provisions of relevant recruitment rules so that the scheme is brought in conformity with the decision / guidelines being conveyed vide this Office Memorandum. Assessment of Scientists from 01.01.2011 shallbe done accordingly.

3. The Ministries/Departments may bring the Scheme to the notice of concerned autonomous Organizations under their control for being placed before their respective Governing Bodies.

i. The Flexible Complementing Scheme in position in certain scientific Ministries/ Departments/ Organizations of the Government shall continue, and promotions under the FCS shall be limited to posts carrying a grade pay of Rs.10,000 or lower. The merit based promotion scheme in the Departments of Space, Atomic Energy and DRDO shall also continue and promotions under the scheme shall be limited to posts carrying a grade pay of Rs.12,000 or lower.

ii. All the posts covered under FCS shall carry the following uniform pay bands/ grade pay, designation and the minimum residency period linked to performance.

Subject: Promotion of Assistant to the grade of Section Officer of Central Secretariat Service (CSS) on ad-hoc basis.

The undersigned is directed to refer to this Department’s OM of even number dated 7.6.2010 on the subject mentioned above.

2. Considering the fact that posts are lying vacant in the Section Officers' Grade in various Ministries/Departments mainly on account of litigation, it has been decided that eligible Assistants of SCSLs 1998 (General Category), upto SCSLs 1999 (SC Category) and upto SCSLs 2001 (ST Category) may be promoted to the grade of Section Officer on ad-hoc basis to the extent of vacant posts (including the posts falling vacant due to retirement upto 31.12.2010) available in the Cadre Units. The ad-hoc promotion/appointment would be subject to the following conditions:

(i) The period of ad-hoc promotion would be upto 31.12.2010 or till the regular Section Officers are made available, whichever is earlier;

(ii) The ad-hoc appointments shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of Section Officers for regular appointment or to claim seniority in the Section Officers grade of CSS;

(iii) Ad-hoc appointments would continue till regular candidates in Section Officer Grade are available either through Seniority Quota or Limited Departmental Competitive Examination (LDCE). In the event of the ad-hoc appointees not qualifying for regular appointment in either of these two categories, they will be reverted to the Assistants' Grade on availability of such regular officers from the date they (regular Section Officers) join duty in their respective cadre units allotted to them by this Department;

(iv) The effective date of ad-hoc promotion in respect of those found fit and clear from vigilance angle would be the date from which the officer concerned joins duty in Section Officers’ grade in his own cadre unit.

3. If any of the Officers, who is eligible for promotion in Section Officer grade on ad-hoc basis and is on deputation, he/she may be given option to revert within one month with a view to avail of the promotion on ad-hoc basis.

4. All the Cadre Units are requested to take urgent action to promote eligible Assistants to the grade of Section Officer on ad-hoc basis and a copy of the appointment order may be endorsed to this Department.

5. After the completion of the process as indicated in para 4 above, all the Cadre Units are requested to convey the details of the Assistants promoted on ad-hoc basis in Section Officer grade after the issue of this order and the number of remaining eligible Assistants upto SCSL 1998 (Gen), upto SCSL 1999(SC) & upto SCSL 2001 (ST) along-with the details of the eligible Assistants in SCSLs 1999 to 2002 (Gen), SCSLs 2000 to 2002 (SC) and SCSL 2002 (ST) in the enclosed proformae latest by 30.9.2010.

Sub: Extension of Modified Assured Career Progression Scheme to the Staff Car Drivers of Central Government.

The undersigned is directed to refer to this Department's O.M. No.35034/3/2008-Estt. (D) the 19th May,2009 regarding introduction of Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees and to say that para 13 of Annexure-I of the Scheme provides that Existing time-bound promotion scheme, including in-situ promotion scheme. Staff Car Driver Scheme or any other kind of promotion scheme existing for a particular category of employees in a Ministry/Department or its offices, may continue to be operational for the concerned category of employees if it is decided by the concerned administrative authorities to retain such Scheme, after necessary consultations or they may switch over to the MACPS. However, these Schemes shall not run concurrently with the MACPS.

2. In pursuance of the decision taken in the meeting of the Departmental Council (JCM) of Department of Personnel & Training held on 08.05.2010 in respect Agenda Item No. 57.31, it has been decided in consultation with the Department of Expenditure, the benefits of the MACPS shall also be extended to the regular Staff Car Drivers of the Central Government Ministries/Departments/Offices, as a fall back option, if they are unable to get promotion within the percentage based present system.

3. Para 13 of the Annexure-I of the MACPS accordingly stands modified to this effect. In other words, the Staff Car Driver Scheme and the MACPS shall run concurrently.

4. All Ministries/Departments may give wide circulation to this decision for general guidance and appropriate action in the matter.

            After issue of DOPT O.M. No.31011/2/2003-estt.(A) dated 18/6/2010 regarding relaxation for travel by air to visit J&K, clarifications have been sought by Government servants/various Ministries/Departments from time to time. The doubts raised by various authorities have now been clarified by Ministry of Finance (Department of Expenditure) as under:-

1 Whether entitled officers can travel by Private airlines to J&K ? Yes. Travel by private airlines is available to all the categories of Government employees including those entitled in travel by Air.
2 Whether the restriction of LTC 80 fare of Air India will apply in these cases ? LTC 80 fare would apply to all cases including those entitled to travel by air irrespective of their airlines.

A reference is invited to this Department OM of even No. dated 24.04.09 on the above subject. The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in the various grades of PB-3 and PB-4 w.e.f. 01.01.2006 was circulated in this Department OM of even No. dated 21.05.2009.

2. The matter has further been considered in this Department. As there is a slight change in the date of posting of first officer of IAS cadre in the Center after 01.01.2006 in the grades of Additional /Joint Secretary, a revised list in supersession of the list issued in OM dated 21.05.2009, giving the batch of the IAS officers who have been posted in the Centre in the various grades as well as the date of posting of the first officer belonging to the batch is annexed. Necessary action may be taken for grant of higher scale for the Officers belonging to batches of Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department OM of even number dated 24.4.2009.

In addition to the above 14 Compulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State. The final list applicable uniformly to all Central Government offices within the concerned State shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. 3.2 No substitute holiday should be allowed if any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other non- working day or in the event of more than one festivals falling on the same day.

4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu'l Fitr, Idu'l Zuha, Muharram and Id-e-Milad, if necessiuy, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu'l Fitr, Idu'l Zuha, Muharram and Id-e-Milad.

5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2011, Diwdi (Deepavali) falls on Wednesay, October 26, 2011 (Kartika 04). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on "Narakachaturdasi Day". In view of this, there is no objection if holiday on account of Deepavali is observed on 'Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government. However, in the year 20 1 1, Diwali (Deepavali) and Narak Chaturdasi Day, both are falling on the same day i.e. October 26, 2011.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2011, subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Viz. Republic Day, Independence Day & Mahatma Gandhi's birthday.

9. In respect of Indian Missions abroad, the number of holidays may be notified in accordance with the instructions contained in this Department's O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the option to select 12(Twelve) holidays of their own only after including in the list, three National Holidays and Mahavir Jayanti, Christmas Day included in the list of compulsory holidays and falling on days of weekly off.

10. In respect of Banks, the holidays are restricted to 15 days in a year in terms of the instructions issued by the Department of Economic Affairs (Banking Division).

Subject: Holidays to be observed in Central Government offices during the year 2011.


It has been decided that the holidays as specified in the Annexure -I to this O.M. will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2011. In addition, each employee will also be allowed to avail himself/herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure - II.

2. Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:

OFFICE MEMORANDUM


Subject:- Extension of Risk Allowance

    With reference to the decision of the Government to withdraw Risk Allowance w.e.f. 1.4.2009 and replace it with the Risk insurance scheme after consultation with Staff Side, a general instruction was issued by this Department vide OM No.21012/1/2008-Estt.(AL) dated 12th March, 2009 to all Ministries / Department having the component of Risk Allowance to examine the recommendation at para 4.2.68 of Sixth Central Pay Commission in the light of General Risk Insurance package formulated by General Insurers’ (Public Sector) Association of India (GIPSA) and consider as per their specific risk, needs and requirements by the respective Ministries/Departments after consultation with the Staff Side. The compliance report and the decision of the Government in this regard was required to be sent to this deptt. within two months. A subsequent reminder of even no. dated 29.10.2009 was issued by this Department to expedite the compliance report. However, compliance report has not been received by this Department till date.

2.    Keeping in view the requests from certain Ministries/Departments, it has been decided with the approval of Ministry of Finance to extend payment of Risk Allowance upto 30.9.2010 or till such time the Risk Insurance Scheme is finally introduced, whichever is earlier. All the Ministries/Deptts. are requested to ensure implementation of Risk Insurance Scheme before 30.9.2010. No further extension will be considered thereafter.
